On behalf of their client West Valley City, RQN attorneys Justin Toth and Maria Windham sued a sewage sludge processor for allegedly creating a noxious stench that degraded the quality of life for West Valley City residents. The lawsuit sought abatement of the nuisance and also alleged that the nuisance was caused by violations of federal and state environmental regulations. After prevailing against the defendant’s motions and failed interlocutory appeal, WVC settled the case with an agreement that the defendant will cease operations within 5 years and pay the West Valley City $750,000.
